By making a booking, accepting a quotation, or allowing our operatives to commence work, you agree to be bound by these Terms and Conditions. Please read them carefully before using our services.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means the individual, business, or organisation requesting waste clearance or related services from us.

Company, we, us, or our means Waste Clearance Hampstead, the service provider.

Services means any waste clearance, rubbish removal, waste collection, loading, transportation, or related services that we agree to provide to the Customer.

Waste means any items, materials, or substances that the Customer asks us to remove as part of the Services, subject to any exclusions set out in these Terms and Conditions.

Booking means a confirmed request by the Customer for Services on a specified date and time, whether made by telephone, email, online form, or in writing.

2. Scope of Services

We provide waste clearance and waste collection services for domestic, commercial, and other premises. The exact nature and scope of the Services will be as agreed at the time of booking or as set out in any quotation provided by us and accepted by the Customer.

Our operatives will attend the property or agreed location and remove Waste as instructed by the Customer, subject to safety, legal and regulatory requirements, and any restrictions detailed in these Terms and Conditions. The Customer is responsible for ensuring that they have full authority to request the removal of the Waste from the premises.

3. Booking Process

3.1 Bookings may be made by telephone, email, or via any online booking facility we may operate. All bookings are subject to availability and to confirmation by us.

3.2 When making a booking, the Customer must provide accurate information, including the collection address, type and estimated quantity of Waste, access details, preferred date and time, and any relevant site information such as parking restrictions or access limitations.

3.3 Any quotation we provide prior to attendance is based on the information supplied by the Customer. If, upon arrival, the actual volume, weight, nature, or location of the Waste differs significantly from that described, we reserve the right to amend the quotation, adjust the price, alter the Services, or decline to complete the job.

3.4 A booking is deemed accepted only when we confirm it verbally, by email, or by other written communication. We reserve the right to refuse any booking at our sole discretion.

4. Access and Customer Obligations

4.1 The Customer must ensure that we have safe, reasonable, and unobstructed access to the Waste at the agreed time. This includes arranging suitable parking or permits where necessary and complying with any building or site rules that apply.

4.2 If we cannot gain access or are significantly delayed due to access problems, incorrect address details, or failure of the Customer to be present where required, we may apply a waiting charge, a call-out charge, or treat the visit as a cancellation, in which case clause 8 will apply.

4.3 The Customer must clearly identify the Waste to be removed and must not request removal of items that do not belong to them or that they are not authorised to dispose of.

4.4 The Customer must notify us in advance of any hazardous conditions, fragile areas, or potential risks on the premises that could affect the safety of our operatives or the performance of the Services.

5. Pricing and Quotations

5.1 Our prices may be based on a combination of factors such as volume, weight, labour time, type of Waste, and any specific disposal requirements. Any price indications or guides provided before an on-site assessment are estimates only.

5.2 Where possible, we will confirm the price upon arrival and inspection of the Waste before starting work. If the Customer agrees to the price, we will proceed with the Services. If the Customer does not accept the revised price, we may cancel the job and may charge a call-out fee to cover our attendance.

5.3 All prices are exclusive of any applicable taxes, charges, or statutory fees unless otherwise stated. Any such additional amounts will be clearly communicated to the Customer.

6. Payments

6.1 Payment for the Services is due immediately upon completion of the job unless otherwise agreed in writing in advance. For some bookings, we may require payment or part payment in advance to secure the booking.

6.2 We accept typical payment methods such as cash, bank transfer, or card payment, subject to availability and to any conditions we may set. The Customer is responsible for ensuring that funds are available and that the chosen payment method is valid.

6.3 For business or account Customers, payment terms may be agreed separately. If not specified, payment shall be due within 14 days from the date of invoice.

6.4 If the Customer fails to make payment by the due date, we reserve the right to charge interest on the overdue amount and to recover all reasonable costs incurred in pursuing the outstanding sums.

7. Changes to Bookings

7.1 If the Customer wishes to change the date, time, or scope of the booking, they must contact us as soon as possible. We will use reasonable efforts to accommodate changes but cannot guarantee that alternative times will be available.

7.2 If the requested change increases the scope of the Services, we may revise the price accordingly. Any reduction in scope may result in a partial charge, depending on the notice provided and any resources already allocated.

8. Cancellations and Missed Appointments

8.1 The Customer may cancel a booking by giving us notice by telephone or email.

8.2 If the Customer cancels more than 24 hours prior to the scheduled arrival time, no cancellation fee will normally be charged, unless we have incurred specific costs for that booking which we will communicate to the Customer.

8.3 If the Customer cancels within 24 hours of the scheduled arrival time, or fails to provide access when our team attends, we reserve the right to charge a cancellation or call-out fee to cover our time, administrative costs, and any losses incurred.

8.4 We reserve the right to cancel or postpone a booking due to circumstances beyond our reasonable control, including but not limited to extreme weather, traffic disruption, vehicle breakdown, staff illness, or safety concerns. In such cases, we will notify the Customer as soon as practicable and offer an alternative appointment. We will not be liable for any consequential loss arising from such cancellations or delays.

9. Waste Types and Exclusions

9.1 We provide general waste clearance services that cover a wide range of household and commercial items. However, certain types of Waste are restricted or require special handling under applicable waste regulations.

9.2 We do not accept the following Waste unless expressly agreed in advance and subject to additional charges and controls: hazardous or toxic substances, asbestos, chemicals, solvents, medical or clinical waste, pressurised containers, gas bottles, explosives, or any other materials classified as hazardous under relevant legislation.

9.3 Electrical and electronic equipment, batteries, refrigerants, tyres, and other regulated items may be subject to additional recycling or disposal requirements. Where we agree to handle such Waste, separate charges may apply, and we will treat these materials in accordance with applicable regulations.

9.4 If we discover, after commencing the job, that the Waste includes prohibited or dangerous materials, we may cease work immediately, remove only compliant Waste, or cancel the job. The Customer may still be liable for charges relating to the time spent and costs incurred.

10. Disposal and Waste Regulations

10.1 We are committed to handling and disposing of Waste in a responsible manner, in compliance with applicable waste management legislation and environmental standards.

10.2 We will transport Waste only to authorised facilities such as licensed transfer stations, recycling centres, or other lawful disposal sites. We may reuse, recycle, or recover materials where possible, aiming to reduce landfill usage.

10.3 For commercial Customers, we may issue waste transfer documentation where required by law. The Customer must keep any such documentation as part of their own compliance obligations.

10.4 Once the Waste has been removed from the Customer’s premises and loaded onto our vehicle, legal ownership of the Waste may transfer to us or to our appointed waste management partners, subject to applicable laws and any separate written agreement.

11. Customer Representations and Warranties

11.1 The Customer warrants that they are either the owner of the Waste or are authorised by the owner to arrange its removal and disposal.

11.2 The Customer warrants that the Waste presented for removal does not contain prohibited, illegal, or hazardous materials that have not been previously disclosed to us.

11.3 The Customer agrees to indemnify us against all claims, losses, damages, costs, and expenses arising from any breach of these warranties, including any regulatory or legal consequences of handling undisclosed hazardous or unlawful Waste.

12. Liability and Limitations

12.1 We will exercise reasonable care and skill in providing the Services. However, our liability is subject to the limitations set out in this clause.

12.2 We shall not be liable for any indirect, consequential, or purely economic loss, including but not limited to loss of profit, loss of business, or loss of opportunity, arising out of or in connection with the Services or these Terms and Conditions.

12.3 We will not be liable for any damage to property or premises where such damage arises from pre-existing defects, structural weaknesses, poor installation, or where we have followed the Customer’s instructions against our advice.

12.4 The Customer is responsible for moving or protecting any items of special value, fragile possessions, or sensitive equipment before the Services are carried out. We accept no liability for damage to items that the Customer has failed to secure or protect adequately.

12.5 Nothing in these Terms and Conditions shall limit or exclude our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under applicable law.

13. Complaints

13.1 If the Customer is dissatisfied with any aspect of the Services, they should contact us promptly with full details of the issue.

13.2 We will investigate complaints in good faith and aim to respond within a reasonable timeframe. Where appropriate, we may offer to rectify any problem, provide a partial refund, or take other reasonable steps. Any remedy will be at our discretion, subject to our legal obligations.

14. Data Protection and Privacy

14.1 We may collect and process personal information about Customers for the purpose of providing Services, administering bookings, processing payments, and performing our legal and regulatory obligations.

14.2 We will take reasonable steps to keep Customer information secure and to use it only for legitimate business purposes, in accordance with applicable data protection laws.

15. Force Majeure

15.1 We shall not be in breach of these Terms and Conditions nor liable for any delay in performing, or failure to perform, any of our obligations where such delay or failure results from events, circumstances, or causes beyond our reasonable control. This may include, but is not limited to, severe weather, flooding, fire, accident, traffic disruption, industrial disputes, public emergencies, or government restrictions.

16. Amendments to Terms and Conditions

16.1 We reserve the right to update or amend these Terms and Conditions from time to time. Any changes will take effect when published or when communicated to the Customer.

16.2 The Terms and Conditions applicable to a particular booking will be those in force at the time the booking is confirmed, unless otherwise agreed in writing.

17. Severability

17.1 If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable by a court or other competent authority, that provision shall be deemed severed from the remaining provisions, which shall continue to be valid and enforceable.

18. Governing Law and Jurisdiction

18.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them, or with any waste clearance or waste collection Services we provide, shall be governed by and construed in accordance with the laws of England and Wales.

18.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with these Terms and Conditions or the provision of our Services.

By proceeding with a booking or allowing our operatives to commence work, the Customer confirms that they have read, understood, and agree to these Terms and Conditions.
